Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of RideRadar SA (the "Service"), operated by Neversleep Enterprises (Pty) Ltd, a company registered in South Africa, trading as RideRadar SA ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

RideRadar SA is a driver intelligence application for eHailing drivers in South Africa. It provides demand forecasts, hotspot maps, traffic and loadshedding alerts, trip logging and earnings tracking, and AI-assisted dispatch information. The Service is provided as informational guidance only — driving decisions remain your responsibility.

2. Eligibility & Authority

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you use the Service on behalf of a business or fleet, you warrant that you have authority to bind that entity to these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable Use

You must not misuse the Service. In particular, you must not:

  • use the Service for unlawful, fraudulent, or deceptive purposes;
  • send spam or unsolicited communications;
  • infringe any intellectual property or other rights of third parties;
  • upload malware, probe or scan our systems, or otherwise interfere with security;
  • scrape, harvest, or systematically extract data from the Service;
  • reverse engineer, resell, or redistribute the Service or any part of it;
  • circumvent technical limits, plan limits, or usage caps.

5. Intellectual Property

We retain all right, title, and interest in the Service, including software, documentation, branding, and underlying data. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.

6. Your Content

You retain ownership of trip logs and other content you submit. You grant us a limited licence to host, store, and process that content solely for the purpose of providing and improving the Service.

7. Service Availability

We work to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or always accurate. To the fullest extent permitted by law, all implied warranties (including merchantability and fitness for a particular purpose) are disclaimed.

8. Payments, Subscriptions & Billing

Paid plans for South African customers are sold and processed by our primary payment provider, Yoco, which handles card and EFT payments locally.

For international customers, paid plans are sold and processed by our reseller, Paddle. Our international order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for those orders. Paddle provides customer service inquiries and handles returns for international transactions. Payment, billing, tax, cancellation, and refund mechanics for those orders are governed by Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms.

Subscriptions renew automatically until cancelled. You may cancel at any time and retain access until the end of your current billing period.

9. Suspension & Termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends. You may export your trip data for a reasonable period before account deletion.

10. Limitation of Liability

To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Service is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

11. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have exclusive jurisdiction over any dispute, subject to your statutory consumer rights.
